The information and services provided by Gomez DOT SAP Services are intended to assist DOT-regulated employees, employers, and Designated Employer Representatives (DERs) with the Substance Abuse Professional (SAP) and Return-to-Duty process.

DOT SAP Services

Gomez DOT SAP Services provides Substance Abuse Professional services in accordance with applicable U.S. Department of Transportation requirements, including 49 CFR Part 40.

SAP services may include initial evaluations, education and/or treatment recommendations, follow-up evaluations, SAP reports, follow-up testing plans, case coordination, and applicable FMCSA Drug & Alcohol Clearinghouse reporting.

No Guarantee of Return to Duty or Employment

Completion of SAP services does not guarantee:

• A particular SAP recommendation

• A determination of successful compliance

• A negative Return-to-Duty drug or alcohol test

• Reinstatement by a current employer

• Employment with a prospective employer

• Restoration of safety-sensitive duties

The SAP determines whether an employee has demonstrated successful compliance with the SAP's recommendations. The employer or prospective employer makes employment decisions and is responsible for applicable Return-to-Duty testing requirements.

Independent Professional Judgment

SAP evaluations, recommendations, and compliance determinations are based on applicable DOT requirements and the SAP's professional evaluation of each individual case.

Payment for services does not entitle a client to a particular recommendation, report, determination, or outcome.

Education and Treatment

When education and/or treatment is recommended, Gomez DOT SAP Services may provide information regarding appropriate providers or resources.

Unless specifically stated otherwise, outside education and treatment providers are independent from Gomez DOT SAP Services.

Fees charged by outside providers are separate from fees paid for SAP services.

Drug and Alcohol Testing

Gomez DOT SAP Services does not perform DOT drug or alcohol testing.

Return-to-Duty and follow-up testing must be completed in accordance with applicable DOT requirements. Employers and other responsible parties retain their respective responsibilities under DOT regulations.
