DOT SAP Evaluation for CDL Drivers & DOT-Regulated Employees 

DOT Substance Abuse Professional (SAP) evaluation is required for DOT-regulated employees who have violated federal drug and alcohol testing regulations. The SAP evaluation is the first step in the DOT Return-to-Duty process.

Who Needs a DOT SAP Evaluation? 

A DOT SAP evaluation is required when a DOT-regulated employee has a drug or alcohol testing violation. This may include:

• A positive DOT drug test

• A positive DOT alcohol test

• Refusing a required DOT drug or alcohol test

• Certain adulterated or substituted test results

• Other violations of the DOT drug and alcohol testing regulations that require completion of the Return-to-Duty process

Employees cannot return to DOT safety-sensitive duties simply by waiting or taking another drug test. The required SAP process must be completed before the employee can become eligible for a Return-to-Duty test.

What Happens During a DOT SAP Evaluation? 

During the initial SAP evaluation, the Substance Abuse Professional meets with the employee to assess the circumstances surrounding the DOT drug or alcohol violation and determine the appropriate education and/or treatment recommendation.

The process generally includes:

• An initial SAP evaluation

• A personalized recommendation for education and/or treatment

• Completion of the recommended program

• A follow-up SAP evaluation

• A determination of eligibility to proceed to the Return-to-Duty test

• A follow-up testing plan, when required

The SAP does not perform the Return-to-Duty drug or alcohol test. After the SAP determines that the employee has successfully complied with the recommendation, the employer or Designated Employer Representative (DER) coordinates the required Return-to-Duty test.

FMCSA Clearinghouse and the SAP Process 

For CDL drivers subject to FMCSA regulations, a DOT drug or alcohol violation may result in a “Prohibited” status in the FMCSA Drug & Alcohol Clearinghouse. A driver with a prohibited status cannot perform safety-sensitive functions, including operating a commercial motor vehicle, until the required Return-to-Duty process has been completed.

As a DOT Qualified SAP, Nicholas P. Gomez can work with drivers through the required SAP portion of the Return-to-Duty process. Required SAP information is reported through the FMCSA Clearinghouse as the driver progresses through the process.

Completing the SAP process does not automatically restore a driver to “Not Prohibited” status. The required Return-to-Duty test and other applicable steps must also be completed.

How Long Does the DOT SAP Process Take? 

There is no single required amount of time for completing the DOT SAP process. The timeline depends on the SAP’s recommendation and how quickly the employee completes the required education and/or treatment.

Some employees may receive an education recommendation that can be completed relatively quickly, while others may require a more extensive treatment recommendation. The SAP must verify successful compliance with the recommendation before conducting the follow-up evaluation and determining whether the employee is eligible to proceed to the Return-to-Duty test.

Starting the process promptly and completing all recommendations as directed can help avoid unnecessary delays.

Can I Complete My DOT SAP Evaluation Remotely?
